TERMS & CONDITIONS

1. INTRODUCTION

These Terms and Conditions apply to all memberships, programs and services provided by The LAB Performance Pty. Ltd. (“The LAB” , "we", "us" or "our").

In these Terms and Conditions, "you", "your" or "member" refers to any person who accesses or seeks to access The LAB facilities or services.

Members under 18 must comply with the Youth Participation & Age Policy and have a completed Youth Program Waiver & Parental Consent form on file.

By:

  • submitting a membership application;

  • purchasing a casual visit or trial; or

  • entering or using our facilities,

you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

We may amend these Terms and Conditions from time to time. Updated versions will be available online on our website and through GymMaster. Continued use of the facilities constitutes acceptance of the updated Terms.

If you do not agree with any part of these Terms and Conditions, you must not use The LAB facilities or services.

2. GENERAL LEGAL TERMS

2.1 Severability

If any provision of these Terms and Conditions is held to be invalid or unenforceable, that provision will be severed and the remaining provisions will remain in full force and effect.

2.2 Governing Law

These Terms and Conditions are governed by the laws of South Australia, and you submit to the non‑exclusive jurisdiction of the courts of South Australia.

2.3 Force Majeure

The LAB will not be liable for any failure or delay in performance caused by events beyond its reasonable control, including (without limitation) natural disasters, pandemics, government restrictions, industrial action, or failure of utilities or suppliers.

2.4 No Partnership or Employment

Nothing in these Terms and Conditions creates a relationship of employment, partnership, agency, fiduciary duty, or joint venture between you and The LAB.

2.5 Assignment

You may not assign or transfer your rights under these Terms and Conditions without our prior written consent.

3. MEMBERSHIPS & CASUAL USE

3.1 Membership Types

The LAB offers various membership types and casual access options. Specific pricing, inclusions, minimum terms, and cancellation fees are outlined in your Membership Agreement or displayed at the facility.

Membership inclusions may include:

  • gym floor access;

  • basketball court access (subject to availability and bookings);

  • classes or programs where specified.

3.2 Payments

Membership fees are payable in advance by direct debit unless otherwise agreed. Casual visits must be paid in full prior to entry.

Failure to make payments when due may result in suspension or cancellation of access.

3.3 Minimum Term Memberships

Where a membership includes a minimum term:

  • you are committed for the full minimum term stated in your Membership Agreement;

  • after the minimum term, the membership will continue on an ongoing basis unless cancelled in accordance with these Terms.

3.4 Membership Holds

Membership holds may be available after completion of any minimum term, subject to:

  • minimum and maximum hold periods;

  • written notice requirements; and

  • management approval.

Specific hold conditions will be communicated at the time of request.

3.5 Cancellation

Membership cancellations must be submitted in writing using the required cancellation process via email lab46adelaide@gmail.com or through the GymMaster app.

Unless otherwise stated:

  • a minimum notice period applies;

  • applicable cancellation fees may apply if cancelling before the minimum term ends;

  • outstanding fees remain payable up to the cancellation date.

4. ACCESS & FACILITY USE

4.1 Entry & Security

Members and casual users must check in upon each entry using the designated system (app, fob, or sign‑in process).

Access credentials are personal and must not be shared. Tailgating or allowing unauthorised entry may result in immediate termination of access and fees.

4.2 24/7 Access (Where Applicable)

Where a membership includes 24/7 access:

  • access outside staffed hours is unsupervised;

  • no staff assistance is available during unstaffed hours;

  • you enter and use the facility entirely at your own risk.

4.3 Court Access

Basketball court access:

  • is subject to availability;

  • may be restricted due to bookings, programs, or coaching sessions;

  • requires appropriate footwear and conduct at all times.

5. UNDER‑AGE MEMBERS & YOUTH PARTICIPATION

5.1 Youth & Academy Programs

The LAB offers youth training, academy‑style programs, and athlete development pathways across both the basketball court and gym floor ("Youth & Academy Programs"). These programs may include skills training, strength and conditioning, group sessions, and supervised gym access appropriate to the participant’s age, experience, and development level.

Youth & Academy Programs may be delivered as part of LAB‑run programs and/or in conjunction with approved coaches operating within The LAB facilities.

5.2 Parental Consent

All participants under 18 years of age require written consent from a parent or legal guardian prior to participation in any Youth & Academy Program or facility use.

The parent or guardian:

  • accepts financial responsibility for the under‑age participant;

  • consents to the participant’s involvement in physical training;

  • acknowledges and accepts the risks associated with training and facility use; and

  • assumes legal responsibility for the participant’s compliance with these Terms and Conditions.

5.3 Supervision & Restrictions

Access to the gym floor and basketball court for under‑age participants is:

  • subject to age, maturity,

  • experience, and safety considerations;

  • limited to approved times, programs, or supervised sessions; and

  • at the discretion of The LAB management.

The LAB reserves the right to restrict, modify, or revoke access for safety, behavioural, or compliance reasons at any time.

6. INDEPENDENT COACHES & CONTRACTORS

6.1 Independent Coaches

Some coaching, training, and programming services delivered at The LAB are provided by independent contractors and not employees of The LAB Performance Centre.

To the maximum extent permitted by law:

  • The LAB does not control, direct, or supervise the professional services provided by independent coaches;

  • The LAB is not responsible for the acts, omissions, advice, or services provided by independent coaches or contractors; and

  • Any agreement for coaching or training services is between you (or the parent/guardian) and the relevant coach or contractor.

7. HEALTH & SAFETY

7.1 Health Disclosure

You warrant that you are medically fit to participate in physical activity and use The LAB facilities.

You must disclose any medical conditions, injuries, or limitations that may affect your ability to exercise safely.

7.2 Assumption of Risk

You acknowledge that:

  • physical exercise involves inherent risks;

  • injuries may occur, including serious injury or death;

  • you voluntarily assume all risks associated with your participation.

8. CODE OF CONDUCT

You agree to:

  • follow all reasonable directions from staff;

  • act respectfully toward staff and other members;

  • use equipment correctly and safely;

  • return equipment after use;

  • wear appropriate athletic attire and footwear;

  • maintain hygiene standards.

The LAB may suspend or terminate access for inappropriate behaviour, misuse of equipment, harassment, illegal activity, or safety breaches.

9. PERSONAL PROPERTY & CCTV

9.1 Personal Property

The LAB is not responsible for loss, theft, or damage to personal belongings.

9.2 CCTV

CCTV operates throughout the facility (excluding bathroom). You consent to video recording for security and safety purposes.

10. MEDIA & MARKETING

By attending The LAB, you consent to the use of photographs or video recordings taken within the facility for marketing and promotional purposes, unless you notify us in writing otherwise.

11. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

  • you release The LAB from liability for personal injury, illness, death, or property loss arising from your use of the facilities;

  • The LAB’s liability is limited in accordance with the Australian Consumer Law;

  • The LAB is not liable for indirect or consequential loss.

12. COMPLAINTS

Complaints should be directed to The LAB management via email lab46adelaide@gmail.com. We aim to acknowledge complaints within a reasonable timeframe and work toward resolution.

13. CHANGES TO SERVICES OR FACILITIES

We may change:

  • operating hours;

  • equipment;

  • programs;

  • membership pricing (after minimum terms);

  • policies and rules.

Reasonable notice will be provided where required.
